Interrogation in Criminal Proceedings Abstract This thesis focuses on interrogation in criminal proceedings, as it is one of the most often used procedures in investigation of crimes. The first chapter addresses interrogation in the context of the current legislation, i.e. how is this procedure regulated at the statutory level. In relation to the person against whom the proceedings are being conducted, it deals with the right to a formal defence, and then with the right to a material defence and its various aspects. In relation to the witness, the thesis addresses the right of the witness to be represented, the right to refuse to testify and the specifics of interrogation of certain witnesses, including a confidential witness. The second chapter addresses interrogation as a discipline of forensic science, describing how the actual interrogation is conducted in all its phases, i.e. the phase of preparation, the actual interrogation and the subsequent documentation of the interrogation. The use of psychology in crime investigation with a focus on criminal profiling psychology of interrogation. Abstract This paper deals with some forms of usage of forensic psychology in investigative practice. Forensic psychology is subfield of psychology that deals with its usage in law practice. This paper describes historical milestones in this field. Furthermore, this thesis describes legal institutes that enable the use of forensic psychology in practice. After this introduction, the remaining part of the thesis is dedicated to selected forms of practical usage of forensic psychology. Specifically, these forms are criminal profiling and psychology of interviewing. Criminal profiling is a newer method that, based on the evidence found, creates presume profile of the offender. This profile usually contains data on the offender's age, gender, possible employment, and social integration of the offender. The profile can also focus on geographical distribution of crime scenes and based on them the profile can determine the area of probable home residence of the offender. Both these variants are described in section dedicated to criminal profiling. 87 Interrogation tactics ABSTRACT This thesis deals with interrogation tactics. The topic is still relevant as it is one of the most important and used criminal evidence. The aim of this work was to summarize available knowledge from Czech and foreign literature about conducting the interrogation, with a focus on the mistakes caused by interrogators. In addition to describing these mistakes, the work also recommends how to avoid them. Practical examples were obtained from available case-law and interrogation protocols. The analytical-descriptive and comparative method of research was used. The work is divided into five parts, introduction and conclusion. These parts are divided into individual chapters and subchapters. The first part is focused on the interrogation from the perspective of criminalistics, criminal law and forensic psychology. It defines the meaning and the purpose of interrogation and statement, different types and legal regulation. It also deals with psychological aspects of interrogation tactics. The diploma thesis deals with psychological aspects of interrogation. The aim of the thesis is to describe general psychological aspects of interrogation, contained in scientific publications in comparison to practical knowledge, gathered by experienced police detectives. The thesis covers both psychological aspects of interrogated person as well as the interrogator. The thesis is comprised of four parts, each divided into chapters and subchapters. In the first part, the focus of the thesis is on testimony, its creation and above all verifying its credibility, as the primary aim of an interrogation is to achieve a complete and credible testimony. In the thesis, there are mentioned psychological methods how to achieve such a testimony, and at the same time how to avoid psychological errors of the investigator. The core of the thesis is dedicated to the topic of psychology of interrogation. This part is divided into three chapters; first chapter describes perception level of both interrogator and interrogated, the second covers the mutual interaction of both parties, and the third one their mutual communication. This paper deals with interrogation tactics. Using the descriptive-analytical and comparative methods, the aim of this thesis is to analyze the interviewing and the interrogation tactics in the Czech Republic. In some parts of my thesis, these tactics are compared with foreign approaches (particularly the United States and the United Kingdom). The work is continuously connected with the practice through examples from the real interrogation protocols. These interrogations which are in anonymous form anonymous form have been provided by the National Anti-Organized Crime Center and come from a five-year old investigation of an organized group that has committed, especially abroad, crimes against life and health.
